By accessing or using SilentSurf's services, website, browser extension, or mobile applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you ("User") and SilentSurf LLC ("SilentSurf," "we," "us," or "our"). You must be at least 13 years of age to use our Services. If you are under 18, you must have parental or guardian consent.

SilentSurf provides an all-in-one digital privacy and security platform including: a VPN (Virtual Private Network) service for encrypted browsing, an AI-powered ad and tracker blocker, an encrypted password manager, phishing link detection, and an AI-powered privacy assistant.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

You may not share your account with others or create multiple accounts to circumvent restrictions. We reserve the right to terminate accounts that violate these Terms.

SilentSurf offers both free and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis in accordance with our Refund Policy. We reserve the right to change pricing with 30 days notice.

You agree not to use the Services to: engage in any illegal activity; transmit malware, spam, or harmful content; attempt to gain unauthorized access to our systems or third-party systems; violate any third party's intellectual property rights; conduct denial-of-service attacks; harvest or collect user data without consent; or use the Services in any way that could damage, disable, or impair our infrastructure.

Violation of these restrictions may result in immediate termination of your account and potential legal action.

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We operate under a strict no-logs policy with respect to your VPN traffic and browsing activity. We collect only the minimum data necessary to provide and improve the Services.

By using the Services, you consent to the collection and use of data as described in our Privacy Policy.

All content, trademarks, logos, and software comprising the Services are the exclusive property of SilentSurf or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without prior written consent.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SILENTSURF DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. No data transmission over the internet can be guaranteed to be 100% secure.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILENTSURF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability to you for any claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid to SilentSurf in the twelve months preceding the claim.

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason including breach of these Terms. Upon termination, your right to use the Services ceases immediately.

You may terminate your account at any time by contacting us or through your account settings. Termination does not relieve you of payment obligations incurred prior to termination.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware. You waive any objection to venue in such courts.

We reserve the right to modify these Terms at any time. We will provide at least 14 days notice of material changes via email or prominent notice within the Services. Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of those changes.
